Terms of Service

By downloading, installing, or using any mobile game (collectively, the "Games") provided by Modny Games ("we," "our," or "us"), you agree to these Terms of Service.

If you do not agree, do not use our Games.

1. Eligibility

You must be at least 13 years old to use our Games. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use our Games for personal, non-commercial entertainment purposes.

You may not:

Copy, modify, distribute, sell, or lease any part of a Game
Reverse engineer, decompile, or disassemble a Game
Remove or alter any proprietary notices

3. Accounts

You are responsible for maintaining the security of your account. We are not liable for loss resulting from unauthorized access to your account.

We may suspend or terminate accounts that violate these Terms.

4. Virtual Items and Currency

Our Games may contain virtual currencies and virtual items. The specific currencies and items vary by game.

Virtual items have no real-world monetary value and cannot be exchanged for cash or transferred outside the Game in which they were obtained
You receive a limited license to use virtual items within the applicable Game — you do not own them
We may modify, remove, or rebalance virtual items at any time for game balance or operational reasons
Virtual items are forfeited upon account termination or deletion

5. In-App Purchases

Payment

All purchases are processed by Google Play. Prices are displayed before purchase and may vary by region.

Refunds

Refund requests are handled by Google Play according to their refund policy. We do not process refunds directly.

Purchases by Minors

If you are under 18, you may only make purchases with the permission of a parent or legal guardian. We recommend enabling purchase authentication in your Google Play settings.

Unused Balance

Virtual currency remaining at account deletion is forfeited without refund.

6. Randomized Virtual Items

Some of our Games include features that grant randomized virtual items (for example, item summoning or draws).

Where such features exist, all drop rates are disclosed in-game on the Shop screen, accessible before any purchase or use of the feature
Rates are expressed as percentages by item grade
Items obtainable through these features are also obtainable through normal gameplay at no cost
These features may be used with either purchased currency or currency earned through play
Multi-pull options may include a minimum grade guarantee, as described on the Shop screen

Drop rates may be adjusted for game balance. The rates displayed in-game at the time of use are authoritative.

7. Prohibited Conduct

You may not:

Use cheats, exploits, automation software, bots, hacks, or unauthorized third-party software
Exploit bugs or errors for unintended advantage
Modify game files or memory
Attempt to circumvent in-app purchase or advertising systems
Harass, abuse, or harm other users
Use the Game for any unlawful purpose

Violations may result in immediate account termination without refund.

8. Advertisements

Our Games may display optional rewarded advertisements. Viewing advertisements is voluntary and grants in-game rewards. We are not responsible for the content of third-party advertisements.

9. Service Availability and Changes

We may modify, suspend, or discontinue any Game or feature at any time, with or without notice.

We may update game content, balance, and virtual item properties as part of ongoing operation.

10. Termination

We may terminate or suspend your access immediately, without prior notice, for any breach of these Terms.

Upon termination, your right to use the affected Game ceases and all virtual items are forfeited.

11. Disclaimer of Warranties

THE GAMES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our Games will be uninterrupted, error-free, or free of harmful components.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MODNY GAMES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF OUR GAMES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations, so these may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Modny Games from any claims arising from your use of our Games or violation of these Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Korea, without regard to conflict of law principles.

Any dispute shall first be attempted to be resolved informally by contacting plus8841@gmail.com.

15. Changes to Terms

We may update these Terms at any time. Material changes will be announced in-game or through the app store listing. Continued use after changes constitutes acceptance.
